Hi I recently had a visit from a bailiff concerning my son`s unpaid court fine. I reluctantly paid up the sum of 1131 to marstons hoping to get it back from my son. what rights do I have in refusing to pay his debt as I was told they could get locksmith to break in. obviously I don`t have receipts for television and other household items can they recover the debt even though its not mine. its very frustrating as im unlikely to get that money back as he not working. I only paid as I didn`t want it to escalate more costs.

Hi

You cannot be held liable for someone else’s debts, as a general rule.

However, if your Son is living with you, the Bailiffs may tries to enter your home to seize his assets to pay his debts.

They cannot seize your assets, but proving what is his and what are yours may be difficult.

Generally as a rule if the home is yours and your Son just lives with you, the argument is there is a presumption only the stuff in his room is his, unless the Bailiffs have proof to say otherwise.

In reality I appreciate it can be a bit more difficult than that and you will want to avoid Bailiffs being in your home.

Also unpaid court fines is one of those types of debt that a Bailiff can force entry into your home to collect.

I am sorry, but if your Son lives with you, then the Bailiffs can threaten to gain entry to your home to recover debts that he owes.

They can, however, only recover those debts from him and take his assets.
