RePossession

I have received a letter from my previous landlord about the rent I owe to them when I lived there with my ex partner . they have also sent the same letter to my mum saying they are going to her house for the money but I don’t live with my mum and my mum didn’t sign anything to say she would cover for any payments that were not made by me. I live in Scotland I know laws can be a little different here. What should I do to make sure my mums belongings don’t get took.

If the landlord has contacted your mother it could be that they either have that address on their systems, or they are not sure where you now live and are trying to contact you to recover funds owed. You could try contacting the landlord direct to discuss the matter further. It would be surprising if the landlord has taken any formal action against your mother unless she was connected to the previous tenancy (i.e. guarantor). However, if there was a connection, I would suggest seeking further advice.

The landlord would need to take some form of legal action in order to recover any debt. If the case has not been to court then anyone calling at either your or your mother’s property may simply be a debt collector (someone with no legal powers to seize (“attach”) goods). Even if the case has been to court, it’s rare for sheriff officers (who can be authorised to enter a property) to seize goods. They would only be permitted to do so if said goods are yours, not anybody else’s. Whatever stage enforcement proceedings have reached, you may wish to seek some free, local debt advice.
