I split from my ex nearly 3 years ago, we joinly owned the house we lived in. When we split we both moved in with parents and put the house up for sale, after 1 month my ex moved back into the house we both own and took it off the market without my knowing. I asked him to get my name of the mortgage or sell it. Neither of which he would do. I refused to pay the mortgage as he was,nt paying maintainance for our daughter. I have recentley had a letter form the mortgage company saying that payments have been missed and the house may be repossessed.
Where on earth do i stand with all this, i cant afford to pay for a roof over my daughters and my head and help him with mortgage payments for a house i dont live in....what do i do???

If the house is repossessed and there is a shortfall between what is owed and the price the mortgage company sell it on for, then you and your ex will be jointly liable for that debt. If the mortgage is cleared in full by the onward sale then you have no further liability, but the repossession will have affected your credit rating and you may find it harder to get credit in the future.

I am in the same situation however i now live in rented house with my new husband, if i cant pay the shortfall, can they reposses my husbands possessions as the debt is not obviously in his name?
