Partners ex still lives in their house with boyfriend, and refuses to pay mortgage |

My partner of four years has been seperated from his EX (they didnt marry but have two grown up daughters 24,20) for four years. he continued paying the mortage for 3 of the years because his daughter was still at home, his ex moved the boyfriend in over 2 years ago so my partner and his ex decided they would split the mortage and pay halves, now the daughter has come to live with us because she doesnt get on with the boyfriend, loads of drama's and fights. We thought it would be an idea to buy them out as the EX wanted to move on and start anew, we got a solicitor to draw up dee of trust which would remove her from any responsibility, I then put my house on the market which would give us the money to buy her out, we were 3 weeks away from moving, and she now decided she wants to sell their house, and would pay the full mortage, whilst selling the house, shes missed the 1st payment and refuses to pay, allowing for the hosue to be repossessed, obviously we dont want this, pls HELP!!!!!

If the mortgage is in joint names then your partner and his ex-partner are both jointly and severally liable for it. Therefore they are jointly responsibility for any payments due prior to the sale of the property and when the sale of the property goes through they would both receive 50% of the equity.
Houses are not repossessed quickly, as there is a clearly defined process that needs to be followed and this takes time. It is likely that if the house sells relatively quickly this process could be completed before the house is repossessed, however it would be wise to seek help from a money adviser if possession proceedings commence to ensure the courts allow time to sell.
