Are they being unreasonable? Can you advise? |
last year our home was going to be repossessed, however when we went to the courts we managed to come to an agreement of paying the monthly payments and certain amount on top, which was £1500 p/m, due to domestic reasons we fell back on part of a payment last month. As said we were going through domestic problems therefore communication between the bank and us was minimum. 3 wks after missing part of the payment(£600) we recieved a letter stating repossession procedures have begun again. I accept the bank tried to contact us but due to our personal situation we didnt respond.
I rang the bank explaining our situation and how I will be able to bring the account upto date in a month but they didnt want to hear anything of it. They said the only way they can stop proceedings is by us paying 75% of the arrears altogether. This means the need us to pay £7500 to stop all proceedings. Any advice?
Re: Are they being unreasonable? Can you advise?
If there is a suspended possession order (from the first hearing) on the property you need to seek advice immediately from a solicitor (perhaps at the Community Legal Service), a housing advisor at the CAB or at the housing helpline Shelter.
Especially since 75% of arrears is £7500, which means you owe at least £10,000.
There is help available from a number of sources including the government Mortgage Rescue Scheme but you do need specialist housing advice immediately..
