I would like some advice on how to go about recovering a debt.


Hello, I am the freeholder of a property containing 4 flats, one of which I hold the lease for. I bought the freehold recently as the previous freeholder was refusing to carry out much needed renovations to the property. I consulted extensively with all the leaseholders and presented them with estimates and got the go ahead for the work. One of the leaseholders now seems to be refusing to pay - I say seems to be, because he has changed his mobile number and has not responded to e-mails or letters to his permanent address.

The amount owed is £1100 - can I take this to the small claims court myself, if so, how do I go about it, or do I need to employ a lawyer/solicitor. Will the leaseholder be also responsible for the fees I incur in trying to recover the debt?

You can make a small claim through the County Courts system, either in paper or online at www.moneyclaim.gov.uk . The online procedure will take you step by step through what to do and what costs you can include.
