Default notice on credit file : I have been offeredd compenastion can I get default notice


I have a default notice for £310 as a result of a dispute with a bank, The FOS have now adjudicated the case and have come back with an offer from the bank of £220 compensation part for incorrect records and part fro stress etc.

Whilst the £220 as an offer is fine - Am i able to then either ask the FOS to make it a condition that the default notice is fully removed or accept the compensation and THEN press through the courts to get the default notice removed

Under the argument that - had the bank only been asking for £90 i would have paid it there and then and equally they are listing a default notice for £310 which is now unjustified ??

any legals bods out there ?

If the registered default is now judged to be incorrect, the bank should remove the notification from your credit record without the Ombudsman requesting it. However, it would be best to write to the bank and ask for confirmation they have done this. Once you have received this confirmation you can check with Experion and Equifax (the credit scoring agencies) that the default has been removed by requesting a copy of your credit record.
