Firstly, yes he should have declared them even though he may not be making payments to them.
Are you sure he has not discussed them with his Insolvency Practitioner? It could be that he has and all the circumstances surrounding the details of your separation and property have been reviewed.
If he has not been at the property now for quite a few years then it may have been deemed that he has no claim to any equity of which would need to be pledged into his IVA.
This is quite a complex question, if there were any equity and he had declared the property, the Insolvency Practitioner would need to seek your permission to agree to releasing his share.
