Am I responsible for my missing son's debts? |
My son went missing March 2010. The police have investigated and he is currently listed as "a missing person" (possible suicide). He had his own business and over the last year I have been made aware of the possibility that my son has forged my signature to obtain credit and leases for business purposes. The companies involved are hounding me (court decrees and CCJs) even after I have written to them advising them of the current situation the family are dealing with. My own credit has now been affected with some of the activity having been frozen. I have been given conflicting advice: " I'm responsible, sell assets and pay debts", "just ignore and let them chase", "not your debt, do not pay, defend court action". I'm at my wits end and don't know what to do. Can anyone advise?

If the signatures are fraudulant then the polive should in theory be dealing with this as a separate case, in which case you can advise the companies chasing you of this so then they cannot hound you for the debt; until this has been confirmed. I would contact the police and explain this and they should then advise what they can do regarding the fraudulant sigantures.

You are not liable for your son’s debts however it would be your responsibility to prove that the debts had been taken out fraudulently. Please seek further free debt advice.
