Can I still go ahead with a DRO if I move in with my boyfriend? |
In my current circumstances I know I am eligible to apply for a debt relief order, as I have had reliable advice that this is the case. However, I have had certain qualms about whether this is the right way to go, and therefore haven't set it in motion yet. What I really want to do right now is move in with my boyfriend, maybe even get married, but without saddling him with my debts. I'd been assuming that this wouldn't be possible, but have recently been reading things that made me think again. Can anyone advise whether I would still be able to go ahead with the DRO on the basis of my own individual income and assets etc. if I moved in with / married him, or whether our circumstances would then be treated as one unit?

If you have no assets at all (or pension you have previously paid into), less than £50 left over once you have paid out your essential living costs and less than £15k of debt then you will still qualify for a DRO.
The DRO will always just look at your debts and circumstances if you advise these were ran up before you met your partner, unless your income increases the DRO will remain in place until you are discharged after the year
If you are unsure this is the right way to go at the moment, you can always offer token payments to your creditors until your circumstances improve which may give you breathing space, not all creditors will stop interest and charges and it is not in itself a solution to a debt problem.
