I have been in a debt management plan with my wife for a while now with payplan (3 Years) we owe approximately 40k still. These debts are all unsecured apart from one, The finance company at the time (Alliance & Leicester) took us to court for a charging order and this was granted that is the only debt we have in joint name. All the other debts are mainly mine but they made my wife do the debt management plan because of the joint loan. Apart from the joint loan my wife's personal debts are only about 3k but she helps me pay towards this plan. We own our own home (Joint Mortgage) but have got minimum equity in the house to pay the debts off. In theory she is not liable for the debts in my name is she?

This is correct. Your wife is solely liable for debts in just her name and jointly liable for debts in both of your names. The DMP provider has probably asked for both of you to be involved in the repayment of the debts based on your household income and that it is often hard to ascertain a division of household expenses/liabilities between spouses.
