My daughters ex has a debt,and as they can't find him they're trying to force her to pay it.


My daughter split from her ex about 7 years ago, is now married with an 8 month old baby, and the debt collectors are trying to make her pay the debt. She keeps telling them where he lives but they seem intent on her paying the debt in full. How can she prove the debt isn't hers and stop the bailiffs calling? When she split from her ex she let him have the house on the condition her name was taken off the debt. She thought it was all sorted until the debt collectors started hassling her, they made her pregnancy hell and she's worried sick!

The answer to this question depends on what kind of debt we are talking about.

If it is in joint names then both parties are jointly liable and either or both can be chased for the debt - there is every chance both of them are being chased.

If you want to prove the debt isn't yours, ask the creditor for the proof of the debt - a signature on a credit agreement for example.

You mention bailiffs. Are you sure they are bailiffs, as these are far more serious than ordinary debt collectors.

It would probably be best if your daughter called us at Debt Advice Foundation with the full facts.
