question category: CCJ

can a creditor ask me for more money than what i owe on my ccj

i received a ccj telling me i owe one amount, and the creditor is telling me i owe a different amount which is considerably higher. They said this was because they only put a part claim in to keep costs down and i still have to pay the rest. Can they do this?

Re: can a creditor ask me for more money than what i owe on ...

Its strange that they only put in a claim for part of the amount. Was it two separate accounts and they sued you for one?

However they are right in that you don't need to have a CCjs against you to owe money! 99.9% of debts aren't CCJs.

Of course if you refuse to pay they could always go back to court and obtain judgement for the other debt.

I'm a bit confused about the details but if you want a better answer you can always click on my name and email me at the Debt Advice Foundation.

Creditor ask me for more money

Doesn't sound like they are playing fair does it. I would do the following.

  1. Only communicate with them in writing. If they call tell them that you won't discuss your finances over the phone and would they write to you. Copies of all correspondents will help your case should it go to court.
  2. Ask for a full written statement of how they got to the amount that they say you owe.
  3. Compare this statement with the CCJ - Is it different?
  4. Get advice from the court and citizens advice

Let us know how you get on.
