If my husband goes bankrupt will it effect me?


I am unempoyed due to long term health issues and in recipt of incapacity benefit and disability benefits. We live in a rented house. If my husband who has lost his job goes bankrupt because of loans and credit cards in his name only, will it effect me in any way?

I can reassure you the effects will probably be very limited in your case.

Any debt in joint names will fall on you. Your household income can be used to calculate how much your husband pays towards his debts in an Income Payment Arrangement. His address will be advertised in your local paper, the London Gazette and on the Insolvency Service website.

My husband who I am separated from for 2 years, not legally those, has acquired debts to credit cards and a CCJ which has been attached to the mortgage. The mortgage is in joint names and we have a loan attached to the mortgage in joint names. I pay the mortgage from my bank account as well as all the utilities. He pays the mortgage loan. If he declares bankruptcy will I lose the house? Is it in my interest to divorce him?
