are all my debts written off if i go bankrupt, even family ones?


I went bankrupt last year but I owe a family member £5000, can I be taken to court for this. I was told I couldn't include personal debts on my bankrupcy application. I am unemployed and have no means to pay back any of the money yet.

Also if i move in with my girlfriend can she be liable for my debts or it affect her credit rating in anyway?

I'm a bit confused so if I have the wrong end of the stick please ignore the following.

Its strange that you weren't allowed to add family debts to your bankruptcy as you are not allowed to continue paying any creditor directly.

I would get some clarification from your Trustee on that point. Your family member can take you to court if they can prove their debt (and verbal contracts are binding) but while bankrupt their claim would be against your bankruptcy.

All your unsecured debts would be discharged in bankruptcy. However after your bankruptcy ends it's your business what you do with those debts and with it being a family member I imagine you should consider paying it back if possible.

It would be unusual for a member of your family to take you to court, but they could. They don't normally have a contract or agreed payment terms.

Your girlfriend is not going to be liable for your debts, and her credit file is not likely to be affected. If it is, she can get a Notice of Disassociation.
