About to go through bankruptcy, how long before I loose my house?


I am about to go bankrupt and have been advised it is likely I will loose the house as I have no assets and negative equity, how long before I loose the house and need to move out of the property?

Just to clarify, you would be protected from price rises if your partner negotiated a price for your equity and paid it. If it is in negative equity then it is likely not to be affected, except for a nominal price. I would certainly advise that any equity should be dealt with as early as possible in the bankruptcy. In the event that the OR decides to repossess the property it is likely you will be give a year to quit assuming you have dependants. The OR does have 3 years to take action against a property.

 

Bankruptcy, negative equity and moving out of home

As your home is in negative equity there is nothing to be gained by taking your home. Your trustee will have an interest / claim on your home for three years, but you can offer to purchase your trustees claim for a token amount. If you do then you are protected from the value of the home rising during the three years and them wanting to sell it to realise the equity.
