need help with bailiff. demanding money for council tax and havt been in property long, |
moved in 9months ago. ive paid a few months of the 9months but got behind recently a couple months due to being in hospital and council have already put it onto bailiff trying to get a whole years payment!! i havnt even been here long enough. they want money going into march 2010. what if i wernt here then, they would owe me. i gave him £300 to try and catch me up with those couple months i have missed, but he still wants £1000, i have offered monthly payments of £150, but he said no, he must collect full amount, technicaly i only owe about £250 to catch up. can they actualy demand future monthly payments? dont make sense. i paid him £300 3wks ago, and im willing to start payments of £150 each month from 11th dec. im just sooo scared they are goin to take belongings when they havnt given me a chance. so far since march i have paid about 4 1/2 months of the 9months in council tax. can they actualy do this over 41/2 months missed, even thou im willing to pay it off £150 mth

I agree is doesn't sound like it makes sense but if you miss enough payments on your council tax you lose the right to pay in instalments.
The whole years bill then becomes due and if you don't pay - the council will go to the magistrates court to get a liability order against you.
You must act quickly.
The bailiff is an official of court and is enforcing that order, its very unlikely he will make an arrangement with you and they usually add very high fees.
As you will have seen elsewhere on this site bailiffs are almost a law unto themselves especially when collecting council tax.
You should speak to the council and the magistrates court about your situation. Try to get the council to take the debt back. Ask the court to set aside the bailiff warrant while you make an arrangement with the council.
After all - if you are offering £150 per month and the bailiff isn't accepting it - I'm sure the council will want to know.
Ultimately we need to get the bailiff laws changed. If all else fails make sure your local councillor and even your MP are aware of the situation.
