my son has just moved back in with me after racking up debts, can they take my possesions?


its my home, I own it and everything in it, my other sons live here with there own possessions, the son who moved back moved back with nothing but the clothes on his back so, can bailifs after outstanding council tax take anything out of my home??

The first thing is not to let bailiffs in if they turn up. Also, get your son to talk to the court about paying the debt. If he ignores the problem he'll be making it worse for himself and you.

If they are allowed in you need to show them than the possession of value in the house are not your sons. The onus is on you to show your things are yours. Any evidence you have i.e. receipts etc is useful. Plus evidence of when he moved back in. Hopefully common sense would take over.

Further to the above be warned that bailiff costs are ridiculous, if they do come to your house they may charge several hundred pounds for the privilige and they will not usually demonstrate common sense.

You should contact the council and the court to explain the situation.

Do not let them in no matter what they say. Ask the Bailiff to take it back to court. Your son needs them to start paying regularly and contact the court to organise to reset the repayments.
