can they take my pocessions for my partners bank debt?

i have lived in my property for 5 years and my partner 2. a collections agency are threatening legal proceedings on my partner, what does this mean? will they send baliffs?. i own everything in my house and dont want them to take my stuff. what happens if i kick him out as the debt is in his name? the bill is from the bank which he hasn't used for at least 2 years. he went over his 450 overdraft and was charged upto £100 a month.we spoke to the bank on several occassions who said they would stop interest charges if he no loger used it which he hasnt, but we still get £15- £20 worth each month making the debt a total of £1023 to date. we also explained to them that if they give the charges back he would pay the whole thing off but they are in the middle of a court case and nothing can be done untill they lose. now he's got this letter which i cant afford to pay as i have recently lost my job and his wage doesn't even cover the bills. i just dont know what to do. please help

Re: can they take my pocessions for my partners bank debt?

So have I got this right?
Your partner owes the bank £1023 - mostly because of bank charges. The bank have now passed the debt to a debt collections agency who are going to try to collect the debt.

The good news is your property should be safe, bailiffs are officials of court who collect on county court judgments. If the collections agency haven't got a county court judgment your partner will not be dealing with bailiffs.

However if he doesn't deal with this debt, the debt collections agency might decide to take it to court.

The good news is - its usually quite easy to make an arrangement with a debt collections agency.

If your partner needs help with that he can always call us at Debt Advice Foundation
