can ballifs come to my house and take goods for a council tax debt in my mothers name


hi my mother recently moved out of our house and left me and my brother living there.the house is still in her name but we pay the mortgage because we are living there.its easier than looking for alternative accomodation(when the house is payed off she is sighning it over to us any way).but about a month ago we got a letter through the door from balliffs saying that there was an outstanding balance off £1500 for council tax in my mothers name(nearly 2 yrs worth).me and my brother were only living on our own for about a month at this time. the next day the balliff was at the door asking to speak to my mum,i told him that she no longer lived here any more and gave him her number,he later called me back saying that he could not get in contact with her at all so i started paying it off for my mum.i gt the balance to £800 and missed a payment.the balliff has now obtained a warrant to access this property to remove goods,bt all goods r mine nt my mums .can they take any goods

The bailiff does not have the right to force entry into your property and even if he did gain entry he can only seize goods belonging to your mother. However, the onus will be on you to provide proof that the goods in your property are yours so it’s best to prevent the bailiff from gaining entry. You should reiterate to the bailiff company that you were not living in the property when the arrears were accrued and if the bailiff company send the debt back to the council it is important you tell the council this too.
