can baliffs take my things for a debt my husband had prior to our marriage.


My husband has an inland revenue tax debt from 2002. THis was run whilst we were not together and i was living in Cornwall. He now does not live with me in the week and only comes back at weekends to see his son, from a previous relationship. I have now had a letter saying baliffs are going to come and take items from my home. Can they do this?

Hi there

I am sorry to hear of the worries you have.

The bailiffs would need a warrant to remove any items from a property so be sure to always ask them to produce this certification.

Also does your husband actually own any of the items in your home. If you can prove your ownership and not his, then they shouldn't be able to remove any items.

Do double check that you are not liable for the debt in any way and if they claim you are, ask them for proof.

Usually this letter is used as a scare tactic to make you pay.
