question category: Bailiffs

Can the bailiffs still use warrant when fine is Paid direct to court.

7am Monday bailiff arrives demanding £410 for an unpaid fine of £135. This was the first and only correspondence I have had from them

In January I was very ill and it slipped my mind. It was never my intention NOT to pay. When the bailiff called he refused to give me any paperwork apart from a preprinted card with his phone number, name and amount, along with the rights they have to execute a distress warrant. He wanted the money there and then but I am on benefits and couldn't produce £4.10 let alone £410 just like that. I pleaded and begged with him to give me some time to pay. After scaring the life out of me and reducing me to a sobbing wreck he agreed to give me one month.

During subsequent research I was told from what I believe to be a reliable source, to pay the fine online, which I have done in full. They then do not then have the right to execute the distress warrant for their fees alone.

Is this correct and if so what do I do when he comes back??

Many Thanks
