question category: Bailiffs

can a bailiff enter my mums house and taker her possesions for my brothers debts?

my brother recently moved back home with my parents and whilst away has mounted up a few debts. these are mainly mobile phone contracts and unpaid bills. he has had a letter saying they will be sending bailiffs to my parents house if these debts are unpaid. he is out of work at the moment so cannot pay any of these debts and my parents have paid so many for him they are financially unable to do anymore. short of kicking him out they are at there wits end and now dont know where they stand if the bailiffs do turn up at the door. any help or advice would be really appreciated. thank you x

Re: can a bailiff enter my mums house and taker her ...

Bailiff’s cannot seize property of third parties in order to pay a debt, this will include your parents. If/when the bailiffs come to the house they cannot force entry but can come through an open window or unlocked door. Therefore do not open the door to them or let them into the property. Talk to them through a closed door or window and explain that your brother is just lodging in a room and is not the owner of any property in the house.
