Advice needed over council tax baliffs? |
About 9 months ago i lost my property and had to move back in with my mother i have an outstanding council tax bill from that property i admit i never contacted the council to tell them where i had moved to or offer to pay the bill now the first thing i know about this is today a baliff turns up at the door of my mothers property (which she is not pleased with at all) i explained that the property is not mine or none of the property inside is but they didnt seem to even care they only wanted the offer of repayments that they wanted which was a payment of £100 and then £40 a month im unemployed and only get £130 every 2 weeks to give to my mother which does not cover what i eat or use in electricity and everything else yet again the baliffs didnt seem to care and was not interested and just walked of handing me a letter saying i refused to pay. So please can someone tell me what i can do or what rights i have if any.

Firstly, council tax bailiffs do not have any rights to force entry into your home so if you have not already let them in make sure you keep your doors and windows closed and locked so they cannot force entry. Once they have been into the property once they can force entry in future but cannot take any belongings that are not yours. It would be useful to ask a solicitor to draw up a sworn affidavit stating nothing in the property is yours and it all belongs to your mother, this can then be shown to the bailiffs.
